现实生活中，若岗前培训是用人单位安排的、与岗位直接相关的必要培训，且劳动者接受用人单位管理，则可以认定双方存在劳动关系。同时，岗前培训期间是否被认定为劳动关系，关乎员工在此期间受伤能否被认定工伤。工伤认定条件之一是“职工在工作时间和工作场所内因工作原因受到事故伤害”。如果新员工在岗前培训期间，与公司之间存在事实劳动关系，则在培训期间受伤可认定为工伤。
